1. Acceptance of Terms
By creating a Chamabox™ workspace, subscribing to a plan, or otherwise using the Service, you ("Customer", "Group", "you") agree to be bound by these Terms of Service ("Terms"). If you are accepting on behalf of a chama, SACCO, welfare group or other organisation, you represent that you have the authority to bind that organisation.
2. The Service
Chamabox™ is a software-as-a-service platform that helps Kenyan chamas, SACCOs and welfare groups manage members, contributions, loans, repayments, welfare claims, M-Pesa collections, reporting and notifications. Specific features available to you depend on the subscription plan in effect.
3. Eligibility & Account Registration
- You must be at least 18 years old and legally capable of entering into a binding contract under Kenyan law.
- You must provide accurate, current and complete information when registering, and keep it updated.
- You are responsible for safeguarding your password and for all activity that occurs under your account.
- You must notify us immediately at info@chamabox.com if you suspect any unauthorised access.
4. Subscriptions, Pricing & Payments
Subscription fees, member limits and feature inclusions for each plan are published on our Pricing page. Plans are billed via M-Pesa Lipa Na M-Pesa Express to our paybill. By initiating a checkout, you authorise the charge of the displayed amount to the M-Pesa number you provide.
- All prices are in Kenya Shillings (KES) and inclusive of applicable taxes unless stated otherwise.
- Subscriptions renew on the renewal date you select (monthly, quarterly, semi-annual or annual).
- Failure to pay on the renewal date may cause your workspace to be suspended after a grace period.
- We reserve the right to change pricing with at least thirty (30) days written notice.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, money-laundering or terrorist-financing activity.
- Upload or transmit malware, viruses, or any code designed to interrupt or harm the Service.
- Attempt to gain unauthorised access to other workspaces or to Chamabox™ infrastructure.
- Resell, sublicense or rebrand the Service except under a written reseller agreement with us.
- Use the Service to harass, defame or send unsolicited messages to your members.
6. Customer Data Ownership
You retain all rights, title and interest in your group's data ("Customer Data"). You grant us a limited licence to host, process and display Customer Data solely as needed to provide and support the Service. We do not sell your data.
7. M-Pesa & Third-Party Services
Payments are processed via Safaricom Daraja APIs. Successful settlement, refund or reversal of any specific transaction is governed by Safaricom's terms. Chamabox™ is not liable for delays or failures originating in third-party telco or banking systems.
8. Service Availability
We target 99% monthly uptime measured at the application layer, excluding scheduled maintenance and force-majeure events. Maintenance windows will be announced in advance whenever practicable.
9. Suspension & Termination
- We may suspend or terminate your workspace if payment is overdue, if you breach these Terms, or if required by law.
- You may cancel at any time from your billing dashboard or by emailing us. No refund is owed for the current paid period unless required by law or our Refund Policy.
- Upon termination, you may export your data for up to thirty (30) days, after which it may be permanently deleted.
10. Limitation of Liability
To the maximum extent permitted by Kenyan law, the aggregate liability of Chamabox™ for any claim arising out of or relating to the Service shall not exceed the amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential losses, including loss of profit, loss of data or loss of business reputation.
11. Indemnity
You agree to indemnify and hold Chamabox™ harmless against any claim, loss or expense arising from your misuse of the Service, your breach of these Terms, or your violation of any third-party right or applicable law.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya. Disputes shall first be addressed through good-faith negotiation, then by mediation in Nairobi. If unresolved, the parties submit to the exclusive jurisdiction of the courts of Kenya.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email and posted on this page. Continued use of the Service after the effective date constitutes acceptance.
